11.2 Maximum Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APPLICABLE SERVICES DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Premier Financial Assist, its affiliates, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) resulting from or arising out of:

13. TERMINATION

13.1 By You: You may stop using the Services at any time by deactivating your account or otherwise ceasing to use the Services.

13.2 By Us: We may terminate or suspend your access to all or part of the Services at any time, with or without notice, for any reason, including but not limited to your breach of these Terms.

13.3 Effect of Termination: Upon termination, your right to use the Services will immediately cease. Sections of these Terms relating to intellectual property, disclaimer of warranties, limitation of liability, and indemnification shall survive termination.

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the jurisdiction in which Premier Financial Assist is headquartered, without regard to conflict of law principles.

15.2 Arbitration: If the dispute cannot be resolved informally, you agree to resolve any claims arising from or related to these Terms through final and binding arbitration, except that you may assert claims in small claims court if your claims qualify.

15.3 Class Action Waiver: You agree to resolve disputes with us on an individual basis, and you hereby waive any right to participate in a class action lawsuit or class-wide arbitration.
